Liability Waiver and Release

Introduction

This Liability Waiver and Release applies to all participants in Generation Dodgeball programs, including but not limited to Little Dodgers, Mighty Dodgers, Adult Dodgeball Coaching, School Holiday Programs, and special events. By enrolling in our programs, participants (or their parent/guardian) agree to the terms outlined below.

Acknowledgement of Risk

I acknowledge that dodgeball is a physical activity that involves inherent risks, including but not limited to: slips, falls, sprains, collisions, and other potential injuries.

I understand that Generation Dodgeball does not provide personal accident insurance, and participation is undertaken voluntarily and at my own (or my child's) risk.

Waiver of Liability

In consideration for allowing myself and/or my child to participate in dodgeball activities, I agree to the following:

I waive and release Generation Dodgeball (Aust) Pty Ltd, its staff, directors, coaches, and affiliates from any and all liability, claims, demands, or causes of action arising out of any loss, damage, or injury (including death) sustained while participating in any program or activity.

This waiver includes, but is not limited to, risks arising from negligence, facilities, equipment, weather conditions, or other participants — except in cases of gross negligence or wilful misconduct.

Assumption of Responsibility

I assume full responsibility for any injuries or damages that may occur through participation. I certify that I/my child am physically fit and have not been advised against participating in sporting activities by a medical professional.

I will withdraw myself/my child from the activity if I believe conditions are unsafe.

Medical Treatment Consent

In the case of injury or illness, I authorise Generation Dodgeball staff to administer first aid and/or seek medical assistance, including calling an ambulance. I accept full responsibility for any associated costs.

Conduct and Behaviour

I understand that safe and respectful conduct is required at all times. Generation Dodgeball reserves the right to remove participants from the program due to unsafe or disruptive behaviour. Refunds in such cases are at the discretion of the organisation.

Media Consent

I acknowledge that Generation Dodgeball may take photos or video during activities for marketing or promotional purposes. I consent to the use of these materials unless I have explicitly opted out in writing.

Please note: Participants may appear in background footage where exclusion is not feasible.

Legal Rights and Consumer Law

Nothing in this waiver limits rights under the Australian Consumer Law that cannot be excluded. This waiver is intended to operate to the fullest extent permitted by law.
